1. Definition
    2. “Consultancy Fee” Fees charged by Firm for performing Saral Vaastu Consultancy service excluding the amount paid by customer towards CWR (Consultation without Remedy).

    3. “Consultation without remedy (CWR)” Means prediction of problems being faced by the customer based on the analysis of Premises with regard to the date of birth.

    4. “Implementation Period”:-Period of 4 (Four) months from the date of Saral Vaastu Consultancy provided by the Firm (name and details as shall be mentioned in the registration form) to the customer.

    5. “Premises”:- Dwelling house, residential apartment (owned / rented), workplace, office or other properties owned or occupied by the customer at the time of availing the Saral Vaastu Consultancy as shall be mentioned in the registration form.

    6. Saral Vaastu Consultancy”:- Solutions/remedy suggested by the Firm to the customer based on the assessment of the Premises of the customer.

    1. Operating Procedures
    2. Firm shall deploy all necessary resources, including the man-power resources etc. for performing the Saral Vaastu Consultancy services. As part of Saral Vaastu Consultancy services, Firm shall provide customer with selected materials, to be used as per the instructions of Firm and/or its Representatives. Firm shall further be entitled to employ, engage and/or replace such other resources as it deems fit for rendering the Saral Vaastu Consultancy services without any intimation to or approval from customer.

    3. Firm may appoint/nominate representatives (“Representatives”), with all authority necessary to act on behalf of Firm and the Representatives shall, on behalf of Firm, oversee performance of the Saral Vaastu Consultancy services. Firm may, from time to time replace or revoke the appointment of any such Representative.

    4. Customer permits the Firm and/or its Representatives to access and reasonably use, as they deem necessary, the Premises connected with the Saral Vaastu Consultancy services. Customer shall also permit and allow access to Representatives to use reasonable facilities on the Premises and shall co-operate with and provide to the Representatives, from time to time, any additional assistance or resources that the Representatives may require for effectively rendering the Saral Vaastu Consultancy services.

    5. As part of the Saral Vaastu Consultancy services, Firm/its Representatives shall provide suggestions to the customer for 100% implementation at the Premises. Customer hereby agrees to implement such suggestions within the Implementation Period. In the event customer fails to implement the suggestions within the Implementation Period, customer agrees that Firm shall have no liability towards the customer.

    6. After the 100% implementation of suggestions, Firm shall conduct inspection through digital platform and check the status of the implementation. During digital inspection of the implementation, the conversation between the Firm and customer may be recorded for internal review and training purpose. If the customer wants to avail physical implementation check visits in addition to or in place of digital inspection, then appropriate visit charges shall be levied to the customer.

    7. Information contained in the recordings are confidential in nature and Firm shall make every endeavor to maintain the confidentiality of information as such. Firm shall not disclose the information to any person and entity unless otherwise mandated by law other than its Representatives who need to access such information for providing services under Saral Vaastu Consultancy.

    1. Representations and Acceptance by the Customer
    2. Customer acknowledges that he/she understands concept of the Firm, Saral Vaastu Consultancy service and the terms and conditions contained herein and was given ample time and an opportunity to resolve all queries, if any, regarding the concept.

    3. Customer agrees and acknowledges that he/she has voluntarily opted to avail the Saral Vaastu Consultancy services from the Firm. Customer further agrees, represents and confirms that Firm has not induced him/her to avail its services and has not made any representations other than as set out in the terms and conditions contained herein.

      1. Customer acknowledges and agrees that Saral Vaastu concept is purely based on science and an individuals luck.
      2. Every individual is having two types of luck which influences their life namely Personal Luck and Earth Luck. Earth luck can be got from your house / work place irrespective of ownership or rental.

      3. With Earth luck an individual can come out from all sorts of problems like health, wealth, marriage and relationship, education, career etc.

      4. Personal luck depends on an individuals karma and no one can change it. When Earth luck and Personal luck combines simultaneously an individual can achieve whatever you want.

    4. Customer acknowledges that the Firm has not provided any magical remedies or services barred by the law of land

    5. Customer acknowledges and agrees that the Firm does not assure any magical changes but definitely assure you positive results in life related issues by enhancing positive energy at your dwelling and work places and minimize the down slides.

    6. Customer acknowledges to pay INR 500 for seeking prediction for their house from the firm which shall be non – refundable.

    7. Customer understands and agrees that it is required by practise and standard of care to keep records of conversation during Saral Vaastu Consultancy service telephonically or using any digital platforms. Customer hereby gives consent to the Firm for recording of such said conversations.

    8. Customer also understands and acknowledges that implementation of suggestions may require procurement and installation of certain goods / materials and acknowledges that those purchases and installation shall be done by the customer only and the customer shall not hold the Firm liable for any of those purchases and installation or liabilities that may arise pursuant thereto.

    9. Customer further agrees that Firm and its officers, managers, members, directors, employees, successors, assigns, subsidiaries, affiliates, suppliers, and Representatives disclaim all warranties, representations, or guarantees express or implied, statutory or otherwise in connection with Saral Vaastu Consultancy services to be provided herein except as provided for under clause 6.

    1. Obligations of Customer
    2. Customer shall use said selected materials as per the instruction guide provided therewith or of Firm and/or its Representatives. However, in the event of any ambiguity between the two instructions, instructions given by the Firm and/or its Representatives shall prevail.

    3. Customer will not indulge in any manner in any activity that will impact the brand image or create doubt or disparage the services offered by the Firm and/or its Representatives in the minds of the public at large.

    1. Assurance from Firm
    2. Post 100% implementation of remedies and advice suggested by the Saral Vaastu in the house, the individual can expect to get results within 3 - 8 months and if the individual fail to experience any changes, the amount received as consultancy fee shall be refunded after deducting service tax and other taxes as applicable based on the criteria laid out in point 6 (Results depend also on personal luck of an individual)

    3. Firm assures that no magical remedies or services barred by law of land are provided.

    1. Refund of Consultancy Fee
      1. A request for refund of Consultancy Fee in the prescribed form, available on the website or at the nearest office of Firm, shall be entertained subject to the occurrence of the following circumstances
      2. 100% implementation within the Implementation Period by the customer of suggestions provided by the Firm / its Representatives under the Saral Vaastu Consultancy service.

      3. 8 months after the expiry of Implementation Period.

      4. Handing over the said selected material back to the Firm.

    2. If the conditions set out in paragraph 6.1 above are satisfied, Firm, at its sole discretion, shall refund Consultancy Fees paid by the customer for the Saral Vaastu Consultancy services by way of a cheque.

    3. If the conditions set out in paragraph 6.1 above are not satisfied, then customer shall not be entitled for any refund.

    4. Any decision of the Firm in respect of the Refund claim shall be final and binding on the customer.

    5. Amount paid by the Customer for CWR shall not be refundable and does not constitute to be part of the Consultancy Fees.

    1. Return of defective / damaged material
    2. Customer shall perform detailed product inspection upon delivery of said selected material

    3. If customer receives a defective/damaged material, then customer shall contact service center of the Firm within 7 (Seven) days from the receipt thereof.

    4. Upon receipt of your return request, Firm may arrange for a quality check using digital platforms to examine the complaint of the product being faulty/defective. Upon successful validation of the complaint, request for return/replacement shall be processed with regard to the faulty/defective material. The returns/replacements will be accepted for only those materials which are found to be faulty/defective.

    5. Material/s to be replaced are either couriered or hand delivered at the Premises of the customer.

    1. Intellectual Property
    2. All intellectual property rights in the suggestions, , the implementation checklist and said selected materials given by the Firm and/or its Representatives shall remain with the Firm. Customer agrees not to use, copy, or distribute, any of the above other than as expressly permitted herein.

    1. Consent for testimonial release
    2. Interested customer post getting desired results after availing Saral Vaastu Consultancy may voluntarily opt for sharing his/her testimonial with the Firm and the Firm will make necessary arrangements for recording the testimonial of customer.

    3. Customer agrees that testimonial made on behalf of the Firm may be used in connection with publicizing and promoting the Saral Vaastu services of Firm so that more people will be benefitted from this unique concept. Customer authorizes the Firm to use his/her name, biographical information, and the testimonial for the aforesaid purpose.

    4. Customer agrees that Firm shall be the owner of the copyrights of his/her testimonials.

    5. Customer hereby irrevocably authorizes the Firm to copy, exhibit, publish or distribute the testimonial for the purpose of publicizing the Firm's programs or for any other lawful purpose. These statements may be used in printed publications, multimedia presentations, on websites, social media channels, and applications or in any other distribution media. Customer agrees that customer will make no monetary or other claim against the Firm for the use of the statement.

    6. In addition, customer waives any right to inspect or approve the finished product, including written copy, wherein his/her likeness or his/her testimonial appears.

    7. Customer hereby hold harmless and release the Firm from all claims, demands and causes of action which customer, his/her heirs, representatives, executors, administrators or any other persons acting on his/her behalf or on behalf of his/her estate have or may have by reason of this authorization.

    1. Limitation of liability
    2. In no event shall Firm and/or its officers, managers, members, directors, employees, successors, assigns, subsidiaries, affiliates, suppliers, and Representatives be liable to Customer for any direct, indirect, incidental, special, punitive, consequential or exemplary losses /damages (including but not limited to loss of business, revenue, profits, use, data or other economic advantage) whatsoever resulting from any (i) Saral Vaastu Consultancy services offered by the Firm; (ii) errors, mistakes, or inaccuracies of data, content, information, materials provided by customer to Firm; (iii) partial implementation or non-implementation of suggestions given by Firm/its Representatives.

    3. In no event shall the total, aggregate liability of Firm and/or its officers, managers, members, directors, employees, successors, assigns, subsidiaries, affiliates, suppliers, and Representatives, arising from the Saral Vaastu Consultancy services or otherwise, exceed the total amount of Saral Vaastu Consultancy fees actually paid to the Firm by customer.

    4. Customer shall make claim relating to services under Saral Vaastu no later than 12 months after expiry of period of 8 months following 100% implementation of suggestions under Saral Vaastu.

    1. Indemnity
    2. Customer shall indemnify and hold the Firm harmless from and against all claims, actions, damages, losses, liabilities and other expenses (including lawyer´s and other legal fees).

    1. Jurisdiction
    2. Any litigation between the customer and the Firm shall be referred to the arbitration. The decision of arbitration shall be bound to both the parties.

    3. Any dispute, difference, controversy or claim arising out of or relating to the Saral Vaastu Consultancy services shall be subject to the jurisdiction of courts in Navi Mumbai.
